PerfectHeadshots is an online service that enables users to upload photos and receive AI-generated headshots in various professional styles. The service is provided by nineteen78 Pty. Ltd, located in Australia.

These Terms apply to all users of our Services, whether registered or unregistered.

2. Eligibility

You must be at least 18 years old to use our Services. By accessing or using the Services, you confirm that you are legally capable of entering into a binding agreement.

3. User Content

You retain all rights to the content (e.g., images) you upload to the platform (“User Content”).

By uploading content, you grant PerfectHeadshots a limited, non-exclusive, royalty-free, and revocable license to:

  • Store and process your images for the sole purpose of generating headshots
  • Generate AI headshots using internal or third-party models
  • Temporarily retain your data for customer support or quality assurance purposes

We do not use your content to train or improve our models unless you opt in explicitly.

You confirm that you have the right to upload the images and that they do not infringe on the rights of any third party.

4. AI-Generated Content

The headshots generated by PerfectHeadshots are licensed to you for personal and commercial use. You may use them in resumes, LinkedIn profiles, websites, or other promotional material.

You may not:

  • Resell the generated headshots as part of another image generation service
  • Claim the AI model or training system used to produce them as your own
  • Attempt to reverse engineer, replicate, or redistribute the model, prompts, or API

All generated content is delivered “as is,” and we make no guarantees regarding likeness, accuracy, or fitness for a particular purpose.

5. Payments and Billing

One-Time Purchases

Our Services are sold as one-time packages. Prices are listed in USD.

We use third-party providers (e.g., Stripe, Lemon Squeezy) for secure payment processing.

Refunds

Due to the nature of AI-generated content, all sales are final once the generation process begins. If you encounter issues, contact support and we’ll attempt to resolve the issue.

6. Account and Access

You may use the Services without creating an account, but certain features (e.g., image history, remixing, download access) may require authentication.

You agree to provide accurate information and to not impersonate others or misuse any part of the Service.

7. Acceptable Use Policy

You agree not to:

  • Upload images that are offensive, violent, explicit, or otherwise inappropriate
  • Attempt to bypass or interfere with system functionality, security, or access controls
  • Use the service for any illegal, harmful, or deceptive purposes
  • Generate content that violates the rights of others, including likeness rights

The generated headshots are your property, but the underlying models and generation process are proprietary.

The Service may rely on or link to third-party services (e.g., cloud hosting, payment processors, AI model providers such as Fal.ai). We are not responsible for the content or policies of those services.

11. Limitation of Liability

To the fullest extent permitted by law, PerfectHeadshots is not liable for:

  • Any indirect or consequential damages
  • Loss of data or content
  • Errors in generated images
  • Failure to meet personal expectations regarding appearance or likeness

Our liability is limited to the amount you paid for the affected Service.

12. Indemnification

You agree to indemnify and hold harmless PerfectHeadshots, its employees, directors, and affiliates from any claims, damages, or legal expenses arising from:

  • Your breach of these Terms
  • Content you upload
  • Your use of generated content in violation of applicable laws

14. Jurisdiction and Dispute Resolution

These Terms are governed by the laws of Australia.
